Official Rules

ELIGIBILITY: The Off the Roll Tape Sculpture Contest ("Contest") is open only to legal residents of the U.S. and D.C. (excluding MD, NJ, ND, TN and VT) who are 16 years of age and older (18 in ME) at the time of entry. Employees, officers, directors and agents of 3M Company ("Sponsor"), Gage Marketing Group LLC, and their respective parent companies, affiliates, subsidiaries, and advertising/promotional agencies, and members of the immediate family or persons living in the same household of such individuals, are ineligible to participate or win a prize. Void in MD, NJ, ND, TN, VT and where prohibited. Subject to all federal, state and local laws. All eligible individuals as defined herein are referred to as "Entrant".

TO ENTER: Beginning on 11/5/09 at 12:01 am CT through 11:59 pm CT on 2/28/10 ("Contest Period"), a prospective Entrant may go online to www.OfftheRollContest.com ("Site") and accurately and truthfully complete all mandatory elements of the Official Entry Form, including (but not limited to): a) inputting your complete first and last name, street address, city, state, zip code, telephone number, date of birth, email address and number of rolls used to complete the sculpture; b) uploading one to three (1-3) photographs ("Photos" must be GIF, JPG or BMP format and each photo may not exceed 1MB) of a sculpture created using Scotch® Premium Performance Packaging Tape #3850 or, alternatively, using Scotch® High Performance Packaging Tape #3500/3501; (c) inputting the name of your sculpture in English (up to 100 characters, including spacing); and further (d) inputting between one and ten (1-10) sentences (each sentence must be unique and different) in English (up to 500 characters, including spacing) that describes your sculpture (together with all requirements specified in these Rules and on the Site, an "Entry", subject at any time to verification by Sponsor).

ADDITIONAL REQUIREMENTS OF ENTRY: Additionally, to be eligible for Contest judging and prize award, an Entrant/Entry must meet and hereby warrants by Entry submission the truthfulness and accuracy of the following additional requirements:

  • Entrant must demonstrate that the sculpture subject of the Entry was created using Scotch® Premium Performance Packaging Tape #3850 or, alternatively, Scotch® High Performance Packaging Tape #3500/3501. The amount of Scotch® Packaging Tape used to create the sculpture must be 90% or higher;
  • Up to 10% of the Sculpture/Entry may include other materials to support or enhance the sculpture and is limited to wire, cardboard, paint, lighting, wood, fabric and plastic. It may not include words or other objects;
  • Entry must not be obscene, indecent, contain profanities, depict the Sponsor or its products and services unfavorably, and must be suitable for republication/display, as specified in these Official Rules or on the Site;
  • Entry must be original and may not include any third-party intellectual property or rights without Entrant receiving prior permission/consent, including all specifications, uses and republications contemplated for an Entry in these Official Rules, and must not have been previously published or entered in any promotion;
  • Entrant/Entry cannot defame or invade publicity rights or the privacy of any person, living or deceased, or otherwise infringe on any person's personal or proprietary rights;
  • Entrants agree that their Entries become the property of the Sponsor, which hereby has the right to edit, adapt, modify, reproduce, promote and otherwise use Entry materials in any way they see fit without limitation and compensation to Entrant, or those granting consents/permissions as part of an Entry; and
  • Entrants agree to reasonably preserve the sculpture subject of and as depicted in the Entry through Grand and First Prize notification in the event such sculptures will be loaned to Sponsor for up to twenty four (24) months for public recognition and display (described below).


Limit one (1) Entry per eligible person during the Contest Period. All tendered Entries will be preliminarily (and at any time, may subsequently be) screened for conformity with these Official Rules, including any written verification/documentation confirming the requirements and permissions specified herein (including parent/guardian consents, in the case of minor Entrants) requested by Sponsor in its reasonable discretion and upon such screening and any verification, thereafter posted in a photo gallery ("Gallery") on www.OfftheRollContest.com for Public Voting, as described below in the Public Voting section. Tendered Entries that do not fully comply with all requirements set forth herein will be disqualified. All Entries become the exclusive property of Sponsor and will not be acknowledged or returned, provided that upon Entry, Entrants may retain a license to republish any of the Photos accompanied by a link to Site on personal websites or in conjunction with social media platforms/accounts for purposes of communicating their Entry in the Contest and inviting participation by eligible persons via Public Voting. No correspondence regarding the screening, verification or judging status of Entries will be undertaken by Sponsor.

PUBLIC VOTING: Beginning on or about 11/5/09 at 12:01 am CT through 11:59 pm CT on 2/28/10 ("Voting Period"), go online to www.OfftheRollContest.com and follow the online directions to register to vote. Open only to legal residents of the U.S. and DC who are 16 years of age and older at the time of participation. Employees, officers, directors and agents of 3M Company ("Sponsor"), Gage Marketing LLC, and their respective parent companies, affiliates, subsidiaries, and advertising/promotional agencies, and members of the immediate family or persons living in the same household of such individuals, are ineligible to participate. All eligible individuals as defined above are herein referred to as "Voter". Voters can vote for an Entry posted in the Gallery by selecting "Thumbs Up" once throughout the Voting Period. Limit 10 votes per person/email address per day. Each Entry that receives a "Thumbs Up" vote will receive one (1) point ("Public Voting Score").

CONTEST JUDGING:
Round 1: On or about March 15, 2010, an independent, qualified panel of judges selected by Sponsor in its sole discretion, will judge all eligible Entries based on the following criteria:

  • Creativity (50%) - the originality of your idea
  • Execution (30%) - the visible quality of your artwork and its construction Presentation (20%) - how well you present your work in the photo(s) you upload

The twenty-five (25) highest scoring Entries (provided a sufficient number of eligible entries are received) will advance to Round 2 of judging.

Round 2: The twenty-five (25) highest scoring Entries from Round 1 of judging will be re-judged on or about April 1, 2010, by a second independent, qualified panel of judges selected by Sponsor in its sole discretion, based on the following criteria:

  • Creativity (50%) - the originality of your idea
  • Execution (20%) - the visible quality of your artwork and its construction
  • Presentation (20%) - how well you present your work in the photo(s) you upload
  • Public Voting Score (10%) - The number of votes your entry receives from the public

The Entrant submitting the Entry receiving the top score will be declared the potential Grand Prize winner, subject to verification. The Entrants submitting the three (3) Entries with the next highest scores will be declared potential First Prize winners, subject to verification. In the event of a tie of total score between two (2) or more Entries, the Entry with the highest score for Criteria 1 will be declared the potential winner ("Winner"), subject to verification. If a tie remains thereafter, the Entry with the highest score for Criteria 2 will be declared a potential Winner. The judges' decisions on all matters pertaining to judging, administering and/or interpreting the terms and conditions of this Contest are final. Judging will be completed on or about April 30, 2010.

PRIZES: Grand Prize (1): $5,000, awarded in the form a check written in the name of the Grand Prize Winner, and one case (36 rolls) of Scotch® Premium Performance Packaging Tape #3850. Approximate Retail Value ("ARV"): $5,225. First Prize (3): $500, awarded in the form of a check written in the name of the First Prize Winner, and one case (36 rolls) of Scotch® Premium Performance Packaging Tape #3850. ARV: $725 each. Total ARV of all prizes: $7,400. By accepting a prize, Winner acknowledges that Sponsors have not made and are not in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any applicable fund/account, including but not limited to its quality, condition or fitness for a particular purpose. Prize is non-transferable except as provided herein or at the discretion of the Sponsors. No prize substitutions except as provided in these Rules. Sponsors reserve the right to substitute a prize of equal or greater value if for any reason an advertised prize cannot be awarded as intended by these rules; and potential Winners agree to such substitution as a condition of entry in this Contest. Limit 1 prize per household.

GENERAL: Winners are responsible for payment of any income taxes on prizes under applicable federal, state and local laws. Prize winners will be notified by overnight courier and will be required to sign and return an Affidavit of Eligibility, Release of Liability, Assignment of Rights and a Publicity Release (where legal), within 10 days of notification. Additionally, if a Grand Prize or First Prize Winner is under 19 in NE/AL or under 18 in U.S./D.C, his/her parent or legal guardian will be asked to confirm prior permission and consent to Winner's participation in the Contest and agreement to the Official Rules by co-signing and returning an Affidavit of Eligibility, Release of Liability, Assignment of Rights and a Publicity Release as specified in Winner documentation (where legal). Assignment of Rights/Publicity Release documentation may additionally confirm Winner's twenty four (24) month license and associated logistics in regard to Sponsor's retrieval and display (at Sponsor's expense) of the sculpture subject of a Winning Entry at its corporate or other public locations with no additional compensation to the Winner and thereafter, return of sculpture to Winner. In the event of non-compliance with these requirements, prize may be forfeited. In the event that a prize or prize notification is returned as undeliverable, such prize will be forfeited and an alternate winner will be determined.

By participating, Entrants release 3M, Gage Marketing LLC, their respective parent companies, affiliates, subsidiaries, advertising and promotional agencies and each of their respective directors, officers, agents and employees (Released Parties), from any and all liability with respect to participation in the contest or to acceptance or use (or misuse) of any prize or to participation in any prize-related activities or any use of the Entry submitted by Sponsor. Entrants agree to release, defend, indemnify and hold harmless (Released Parties) from and against, and accept all responsibility of any kind, including but not limited to financial, for any liability, claims, losses, damages or proceedings, including but not limited for death, (including reasonable attorneys' fees) relating to any actions taken by entrants, including without limitation all warranties relating to participation and entry in the Contest and use of entrant's e-mail or other identification purporting to act on entrant's behalf in regard to the Contest (whether or not such use occurred with or without your permission). Entrants also agrees to release, defend, indemnify and hold harmless the (Released Parties) from any and all liability, claims, losses, damages or proceedings, including but not limited for death (including reasonable attorneys' fees) relating to Contest prize consideration and Contest publicity, and any other matter in connection with entrants' participation in the Contest. Except where prohibited by law, by accepting prize, Winners agree to use of their first name and first initial of surname, address (city and state only), Entry and any statements made by Winners regarding the contest or Sponsor (provided same are true) for advertising or publicity purposes worldwide without limitation, including the internet, and without compensation, and further grants Sponsor any and all rights to said use. Entrant and his/her parent or legal guardian (if a minor) agree that: (i) any and all disputes, claims and causes of action arising out of or connected with this Contest shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for St. Paul, Minnesota or the appropriate Minnesota State Court located in St. Paul, Minnesota; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest but in no event attorneys' fees; and (iii) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and/or consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the contest, shall be governed by, and construed in accordance with, the laws of the State of Minnesota.
